The following are the terms and conditions of use of this website and its services. If you do not accept these conditions, you must not use this website or services. Please refer to our Privacy Policy. Our holiday terms and conditions can be found during the booking process.

The content on this website is provided ‘as is’, and Errant Ltd give representation or warranty as to the accuracy of the content and assumes no responsibility for errors or omissions in it or the effect it has upon your computer. This site includes links to other sites on the Internet. Errant Ltd cannot vouch for the suitability or accuracy of the content of those sites and so you use them at your own risk. Any references to linked sites or to third-party companies, products or services by name does not constitute or infer its endorsement by Errant Ltd.

The information available on the site might from time to time be incomplete, out of date or inaccurate. Errant Ltd reserves the right at any time and without prior notice to make changes and corrections to the material on the site or to make parts or all of this site unavailable at any time without notice.

Errant Ltd disclaims all liability in respect of all information and its provision, and shall not be liable for any loss or damages suffered as a result of any use of the site. Surfing Holiday Terms and Conditions – Our agreement with you.

When you book a surf holiday, a contract is made when your booking is confirmed in writing or via e-confirmation letter by Errant Ltd. Full payment should be paid at time of booking. For your financial security all funds will be held a third party trust account, in compliance with the Package Travel, Package Holidays and Package Tours Regulations 1992 (SI 1992 No 3288), until completion of your surf holiday (see Client Protection). The Lead person signing the booking form accepts responsibility for payment for everyone listed on the booking and is responsible for ensuring that all other persons listed on the booking form have read the booking conditions below and are aware of the booking details.

Flight arrangements

With so many great offers from online agents and the ever-changing fares, flights should be arranged through an ABTA or ATOL bonded travel agent. Your contract for the flight arrangements is not with Errant Ltd and as such Errant Ltd cannot be held responsible for any delays or other problems, which may arise with your flights.

Changing your booking with Errant Surf Holidays

We will make every effort to arrange any changes you request after the booking has been confirmed, however any changes to dates or courses are subject to availability of accommodation and course places. Please be aware change within 20 days of departure carries an administration charge of £15.

Cancellation of your Surfing Holiday

All cancellations must be sent in writing and will be effective on the date which they are received by Errant Ltd. Cancellation charges are payable as follows:

Period before departure we are notified by writing and the percentage of total cost payable

  • Over 48 days Deposit only
  • 36-47 days  50% of total cost
  • 21-35 days  75% of total cost
  • Under 20 days 100% of total cost

However if your cancellation is within the terms of your insurance policy, you may be able to make a claim.

In extremely unlikely event we may need to charge, alter or cancel your holiday for good reason. We work in good faith and will strive to find a solution should it become necessary to adapt your booking. We reserve the right to make such changes should they become necessary. Most of these changes will be minor and we will advise you or your travel agent of them at the earliest possible date.  We reserve the right in unusual circumstances to cancel your travel arrangements.

If we are unable to provide the booked travel arrangements and have had to cancel them before the holiday is due to start, you can either;

  1. Accept our offer of a replacement holiday of higher or same quality (subject to availability)
  2. Accept our offer of a replacement holiday of lower value and we will refund the difference in cost

No compensation will be paid where the change or cancellation is due to Force Majeure.  Force Majeure means unforeseeable and unusual circumstances beyond our control at Errant Limited, the consequences of which could not have been avoided even if all due care had been exercised.  Such circumstances or events include (but are not limited to) war or threat of war, riot, civil strife, closure or congestion of airports, terrorist activity, natural or nuclear disaster industrial dispute, and unavoidable technical problems with transport, fire and adverse weather conditions. 

Invitation To Treat

Errant Ltd confirms that the display of items, and/or holidays for sale our website, quotes given via e-mail, telephone or Skype are only an invitation to treat. The final price is confirmed by a member of staff upon request of wanting to book. At which point a booking form is complete, and a contract entered into.

Insurance

As with any holiday, full travel insurance is a requirement for all guests booking a holiday with Errant Ltd. Please make sure that your insurance policy covers you for surfing. Failure to take out travel insurance breaks the contract between Errant Ltd and the client.

Suppliers’ Conditions

Suppliers will often have their own booking conditions or conditions of carriage, and you will be bound by those as far as the relevant supplier is concerned. Some of these conditions may limit or exclude liability on the part of the relevant supplier, or give the supplier the right to alter or cancel arrangements without penalty. Where relevant, copies of such conditions will be available for inspection at our offices, or at the offices of the relevant supplier.

Client Protection

All monies paid to the Company will enter a trust account, in compliance with the Package Travel, Package Holidays and Package Tours Regulations 1992 (SI 1992 No 3288), which is supervised by an independent trustee, T Gibbs with HSBC Bank, Mansion House, Newbury, UK. Your funds are held in this account and may not be released until you have returned from your holiday. In the unlikely event of the company becoming insolvent, your payment is protected by the company’s trust account, so your peace of mind is guaranteed. This means that your money will be refunded in the extremely unlikely event of our insolvency.

Not Included in the Cost

Cost of passports, visas where required, gratuities (except where indicated), insurance, flights, excess baggage, laundry, drinks, airport taxes, meals (except where indicated), insurance, items of a personal nature.

Surf Conditions

Our camps are selected for the quality they offer but as a company we are not responsible for poor surf or bad weather.  We select our resort so they perform above average and that they offer good natural environment but if no surf occurs then we cannot offer compensation or alternatives.  We provide details of conditions on our website introductory pages but it is your responsibility to ensure that all conditions are researched by you and that you are happy with the resort selection.

Environmental Dangers

As a surf holiday company Errant Ltd involves a natural environment that we do not control these include but are not limited to snakes, sharks, avalanche and volcanic eruptions to name a few.  Errant Ltd can not be held responsible for these activities or the dangers that you as a customer will experience.  We try our best to ensure safety comes first always but natural things will occur and caution must be taken at times. It is understood that you agree to these dangers when booking.

Paying by Credit or Debit Card

We take most credit and debit cards. If you wish to pay by credit card a charge of 3% is added, if you wish to pay with a debit card there is no charge. We do not take American Express.

Our Liability

(i) Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities and, where we or our supplier is actually providing the service or facility, to provide them and to do so with reasonable skill and care. You must show that reasonable skill and care has not been used if you wish to make any claim. Standards of, for example, safety, hygiene and quality vary throughout the transport and destinations that your holiday may involve. Sometimes these standards will be lower than those  which would be expected to be found in the UK. The services and facilities included in your holiday will be deemed to be provided with reasonable skill and care if they comply with any local regulations which apply (such as, for example, those of the Civil Aviation Authority), or, if there are no applicable local regulations, if they are reasonable when compared to the local standards and customs.

Privacy

We will store and use the information you supply us or which is supplied to us (“your information”) for the purpose set out in our Privacy Policy. You will be/would have been asked to agree to our use at the appropriate time. You hereby authorise your travel insurers and their agents in resort to disclose to us such information as we may reasonably request in the unlikely event that you should become involved in some form of emergency.
